Terms of Service

Caesar Archivum is a small archive of handmade jewellery, owned and operated by Caesar Consortium PTY LTD (), a company registered in Australia. In these Terms, "we", "us" and "our" refer to Caesar Consortium PTY LTD trading as Caesar Archivum. "You" means the person visiting the site or placing a reservation.

These Terms govern your use of caesararchivum.com and any reservation or purchase you make through it. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

Our store is hosted on Shopify. Shopify provides the e-commerce platform through which we offer our pieces.

1. About the archive

Caesar Archivum is run by hand, from the Gold Coast in Australia. We work in three small categories, and the way you order, wait, and (if needed) return a piece depends on which category it sits in.

The categories are:

The Archive (in stock). Pieces that have already been made. These ship from the Gold Coast within 2 business days of your order.

The Final Window (commissioned, made to order). Pieces that are made for you after you reserve them. Sent to the jewellers in small batches. Most pieces are completed within 4 to 6 weeks. A small number, crafted by our specialist jewellers, take 6 to 8 weeks.

The Studio (engagement rings, bespoke). Made one at a time, after design approval and a 50% deposit. Production takes 6 to 10 weeks depending on the design and the stones. Final shipping is fully insured and signature-on-delivery, included in the price.

Where these Terms refer to a "reservation", "order" or "purchase", we mean any of the three.

2. Eligibility

By placing an order, you confirm that you are at least 18 years of age. If you are under 18, you may only use the site with the involvement of a parent or guardian. The site is not intended for use by children.

You agree not to use the site or our Services for any unlawful purpose, and not to interfere with the operation of the site, including by uploading any code intended to disrupt or damage it.

3. Placing a reservation

When you place a reservation, you are making an offer to purchase a piece on the terms displayed at checkout, together with these Terms and our other policies. We confirm your reservation by sending you an order confirmation email.

We reserve the right to refuse, limit, or cancel any reservation. This may happen, for example, where a piece is no longer available, where there is a pricing or description error, or where the order appears to be fraudulent or placed for resale. If we cancel a reservation you have already paid for, we will refund the full amount to your original payment method.

Listed availability is indicative. Where supplier production shifts, we will let you know in writing and offer you the choice to wait, to swap your piece for something available, or to cancel for a full refund.

4. Pricing and payment

All prices on caesararchivum.com are in Australian dollars (AUD) and include GST for orders shipped within Australia. International orders are GST-exempt at checkout and may attract duties or taxes on arrival, as set out in section 6.

We accept payment by credit and debit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay, PayPal, Union Pay, Bancontact, and Afterpay. Buy-now-pay-later providers (such as Afterpay) operate under their own customer agreements, and your use of those services is governed by their terms in addition to ours.

We may change our prices at any time. Changes do not affect orders already confirmed.

If your payment fails, is reversed, or is charged back without good reason, we may suspend the order and contact you to resolve the issue before proceeding.

5. Shipping, lead times, and risk

Lead times, carriers and tracking are set out in our Shipping Policy. The estimates there are made in good faith but are not guarantees. Production timelines, courier delays and customs holds can move the dates.

Risk in a piece passes to you when it is delivered to the address you gave us. If a piece is lost, damaged or delayed in transit, write to hello@caesararchivum.com and we will work it out with the carrier.

You are responsible for giving us a correct delivery address. We are not liable for parcels that go missing because of an incorrect address, an unattended delivery, or a forwarding service used after the carrier delivers to the address you provided.

6. International orders

We ship internationally where the destination is supported at checkout. International orders ship DDU (delivered duties unpaid). This means the receiving country's customs may charge duties, taxes, or import fees on arrival, and those charges are the responsibility of the customer.

If you refuse delivery or the parcel is returned to us because duties were not paid, we will refund the price of the piece (less return shipping and any non-refundable customs fees) once the piece is back with us in original condition.

International orders, other than damaged or faulty pieces, are final sale once shipped. This is set out in our Refund Policy.

7. Returns, refunds, and faults

How returns work, and what we can and cannot accept, is set out in our Refund Policy. In summary:

  • Pieces from The Archive may be returned within 14 days of arrival, unworn, in original condition, with the box and care card.
  • Commissioned pieces (The Final Window) may be cancelled for a full refund within 48 hours of placing your reservation, or until your piece has been sent to the jewellers, whichever comes first. After that point, the piece is being made for you and cannot be cancelled or refunded.
  • Studio engagement rings are bespoke. Once your final design is approved and the 50% deposit is paid, the commission cannot be cancelled or refunded.
  • Damaged or faulty pieces are repaired, replaced or refunded, at our choice, where reported within 30 days of arrival with photographs.

Nothing in these Terms or in our Refund Policy excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the Australian Consumer Law applies, our liability for a failure to comply with a consumer guarantee is limited (to the extent permitted by law) to the repair, replacement, or supply of an equivalent piece, or the refund of the price you paid.

8. Care of your pieces

Care guidance is set out on our FAQs page. Damage caused by wear, by exposure to water, perfume, lotion, chlorine or salt, by impact, by improper storage, or by alterations made by a third party is not covered by our warranty or by our returns process.

9. Intellectual property

The site, the pieces, the photography, the descriptions, the names of pieces, the brand marks, and the underlying designs are owned by Caesar Consortium PTY LTD or used by us under licence. You may not reproduce, copy, resell, or commercially use any part of the site or the designs without our written permission.

You may share photographs of pieces you own on social media. We may, in turn, repost customer photographs, with credit, unless you ask us not to.

10. Personal information

How we collect, use, and share your personal information is set out in our Privacy Policy. By using the site or placing an order, you acknowledge that you have read it.

11. User content

If you send us photographs, comments, suggestions, or other materials (whether by email, social media, or otherwise), you grant us a non-exclusive, royalty-free, worldwide licence to use that material in connection with the brand, including in marketing, with credit where reasonably possible. You confirm that the material is yours to share and does not infringe anyone else's rights. We are under no obligation to use, keep, or respond to any submission, and we may remove any submission at our discretion.

12. Third party links and tools

The site may link to third party websites, or use third party tools (for example, payment providers, courier tracking, or analytics). Those websites and tools are operated by their owners under their own terms and privacy policies. We are not responsible for their content or practices. Please review their terms before you use them.

13. Errors

We do our best to keep the site accurate, but occasionally there may be typos, pricing errors, description errors, or out-of-date information. We reserve the right to correct any error, and to cancel any order placed on an incorrect listing, at any time, even after the order has been placed. Where we cancel an order in this way, we will refund any amount you paid in full.

14. Limitation of liability

To the extent permitted by law (including by the Australian Consumer Law), Caesar Consortium PTY LTD, our directors, employees, agents, contractors and suppliers are not liable for any indirect, incidental, special, or consequential loss arising from your use of the site, your purchase, or any failure or delay in performance.

Where statutory consumer guarantees apply and cannot be excluded, our total liability is limited to the maximum extent permitted by law, and in any case to no more than the price you paid for the piece in question.

Nothing in this section limits or excludes our liability for fraud, for personal injury or death caused by our negligence, or for anything else that cannot be limited or excluded by law.

15. Indemnity

You agree to indemnify and hold Caesar Consortium PTY LTD, its directors, employees and contractors harmless from any claim arising out of your breach of these Terms or your misuse of the site, except to the extent the claim is caused by us.

16. Termination

These Terms apply for as long as you use the site or while we have outstanding obligations to you under an order. We may end your access to the site if you breach these Terms. Termination does not affect any rights or obligations that have already arisen.

17. Changes to these Terms

We may update these Terms from time to time. The current version always lives at caesararchivum.com/policies/terms-of-service, with the "Last updated" date at the top. Continuing to use the site after a change means you accept the updated Terms. Changes do not apply retrospectively to orders already placed.

18. Governing law

These Terms are governed by the laws of Queensland, Australia. Both you and we submit to the non-exclusive jurisdiction of the courts of Queensland.

19. Severability and entire agreement

If any part of these Terms is found to be unenforceable, the rest still applies. These Terms, together with our Refund Policy, Shipping Policy and Privacy Policy, are the entire agreement between you and us in relation to the site and your orders.
